Using of the Official Name of the State in a Trademark

The Government of the Republic of Moldova has taken the measures concerning the using of the official or historical name of the state in a trademark and/or in a service mark.

The Governmental Decree № 1425 dated December 2, 2003 concerning the order and conditions of licensing for using of the official or historical name of the state in a trademark and/or a service mark was published on December 12, 2003 in the Official Monitor of the Republic of Moldova. That Decree approved the Regulation concerning the order and conditions of licensing for using of the official or historical name of the state in a trade mark and/or a service mark as well as the Commission's body on examination of the applications for obtaining such licenses and its Regulation.

AGEPI has undertaken the series of measures on accomplishment of the above-mentioned Governmental Decree. Trademarks and Industrial Designs Department should provide implementation of the adopted Regulations concerning the order and conditions of licensing for using of the official or historical name of the state in a trade mark and/or a service mark and within a month's period to collect the information concerning filed applications for registration of trademarks and/or the service marks containing the official or historical name of the country.

Then it is need to send notifications to applicants and owners of such trademarks about necessity of the submission of the applications to the Commission on examination for obtaining of licenses for using of such names as well as about refusals of the applications for registration or cancellation of registration of the trademarks inclusive the above mentioned names in the case of nonpresentment of such licenses. The text of the Governmental Decree and the Appendix to it will be published in the Bulletin on Industry Property and will place on the AGEPI website.
