Functions of the AGEPI

The Agency carries out the following main functions:
• elaboration and improvement of legislative acts and determination of priorities of the state policy in the field of intellectual property protection;
• creation of national system of intellectual property protection and administration thereof according to the national legislation in force and the international agreements which the Republic Moldova takes part;
• submission of proposals on improvement of national system of intellectual property protection and supervision under observance of the legislation of the country as well as of the international agreements which the Republic Moldova takes party;
• management, storage, improvement and realization of data bases in the field of the intellectual property protection by means of the international exchange and purchases as well as providing access, including automated to national and foreign databases;
• elaboration, coordination and implementation of development programs as well as cooperation agreements with other countries or the international organizations in own sphere of the activity;
• registration and examination of applications for granting of titles of intellectual property protection;
• keeping of national registers of applications and the titles of protection which were granted on inventions, new varieties of plants, trademarks, appellations of origin, industrial designs, utility models, topographies of integrated circuits as well as national register of license agreements, register of contracts concerning cession of rights, registers of patent attorneys, appraisers and patent councilors;
• registration of license agreements and contracts concerning a cession of the rights, as well as agreements of pledge and franchising;
• publication and distribution of patent specifications;
• publication and distribution of the Official Bulletin of the Industrial Property, Journal of intellectual property "Intellectus", other editions in this field;
• organization of activities of patent attorneys, councilors and appraisers of intellectual property as well as certification of them;
• rendering of services and the necessary help in the intellectual property field to the applicants on request or in systematic order;
• defense of rights and lawful interests of authors, owners of the copyright and related rights as well as their assignees on the territory of the Republic Moldova and abroad;
• monitoring activity of the organizations on collective management of copyright and related rights;
• management of authors interests, owners of copyright and related rights as well as their assignees which have not transferred the interests to other organizations of collective management of copyright;
• renders legal aid to authors and owners of the copyright and the related rights as well as taking measures on prevention of infringements and restoration of the broken rights;
• drawing up the reports on copyright and related rights infringements as well as requests for restoration of the broken rights according to the legislation in force;
• delivering of control marks according to the legislation in force.
